§ 74-129. Enforcement.
(a)
A violation shall constitute an offense as set forth below, and each day a violation continues shall constitute a separate offense:
(1)
During a drought watch stage declaration, a written or verbal notice.
(2)
During a drought warning declaration:
a.
First offense: Written or verbal warning.
b.
Second offense: Written warning.
c.
Third or subsequent offense: Written notice together with disconnection of service and payment of reconnection fee and all other applicable charges and fees, as well as issuance of summons for class 1 misdemeanor.
(3)
During a drought emergency declaration:
a.
First offense: Written warning notice.
b.
Second offense: Written notice together with disconnection of service and payment of reconnection fee and all other applicable charges and fees.
c.
Third offense: Issuance of summons for a class 1 misdemeanor, as well as disconnection of service and payment of reconnection fee and all other applicable charges and fees.
(b)
The town manager may also suspend water service to any person violating the provisions of this division or the regulations promulgated under this division, including subsections (a)(1)—(a)(3) above. If such water service is terminated, the person shall pay a water conservation reconnection fee as adopted from time to time by the town council and on file in the town clerk's office together with all charges and fees before service will be restored.
(c)
Repeat offenders of any declaration may, by decision of the town manager in consultation with the town attorney, be charged with a class 1 misdemeanor.
