§ 74-130. Appeal/waiver process.

  • (a)

    If a customer wishing to appeal any decision by the town manager, may do so by making can appeal in writing to the town council within 15 days of the date of the decision. The town council shall hear the appeal and its decision upon the matter shall be final.

    (b)

    Upon prior written request by an individual, business or other water user, to the town council, the town council may permit less than full compliance with any drought restriction, if good cause can be shown, including evidence that the applicant is affected in a substantial manner not common to other persons or businesses generally. No waiver shall be granted by the town council unless it determines that the public health, safety and welfare will not be adversely affected by the waiver. The decision of the town council regarding waivers shall be final.
