§ 74-128. Decisions and data sources.

  • (a)

    The town manager shall interpret local water system data, inclusive of reduction of available water supply to the town, and the town council shall have sole local control over the declaration of a drought/low water supply watch, warning, or emergency, as well as the right to modify, suspend or terminate any such declaration.

    (b)

    The following are the stages for the determination for the following levels of action:

    (1)

    Drought watch stage response. Voluntary conservation. The town manager shall make a general appeal for voluntary conversation of water by individual (both indoor and outdoor uses) and commercial users where there is a ten percent reduction in available water supply, for a savings of at least five percent in water usage.

    (2)

    Drought warning stage response. Mandatory conservation. The town manager shall set forth for individual (both indoor and outdoor uses) and commercial specific conservation activities where there is a ten percent reduction in available water supply, for a savings of at least 15 percent in water usage.

    (3)

    Drought emergency stage response. Mandatory conservation. The town manager shall set forth for individual (both indoor and outdoor uses) and commercial specific conservation activities where there is a 20 percent reduction in available water supply, for a savings of at least 15 percent in water usage, and the town manager may restrict or discontinue the supply of water to any industrial or commercial activity which uses water beyond the sanitary and drinking needs of its employees and invitees.

    (c)

    The town council shall determine the appropriate data and other information sources to be used by it upon which it bases any declaration under this division.

    (d)

    In the event that the water usage reduction measures, whether voluntary or mandatory, prove inadequate in the judgment of the town council, it shall have the authority to impose additional measures to conserve the town's water supply.
