§ 26-157. Penalties, injunctions and other legal actions.

  • (a)

    A violation of this article shall be punished as provided in section 1-9.

    (b)

    The town may apply to the circuit court to enjoin a violation or a threatened violation of this article, without the necessity of showing that there does not exist an adequate remedy at law.

    (c)

    The attorney for the commonwealth shall, upon request of the town, take legal action to enforce this article.

    (d)

    Compliance with this article shall be prima facie evidence in a legal or equitable proceeding for damages caused by erosion or sedimentation that all requirements of law have been met, and the complaining party must show negligence in order to recover any damages.
